By accessing, browsing or using this website, you agree to the terms, conditions and disclaimers herein as amended from time to time. The Hamper Emporium may amend these Terms and Conditions from time to time and any amendment will become effective immediately. Your continued use of this website after amendment constitutes an agreement to abide by and be bound by those Terms and Conditions, as amended.

Trademarks, Copyrights and Restrictions

All material on this site, including, but not limited to images, illustrations, audio clips, and video clips, is protected by copyrights, trademarks, and other intellectual property rights which are owned and controlled by The Hamper Emporium, its related companies or by other parties that have licensed their material to The Hamper Emporium. Material on this website is solely for your personal, non-commercial use. Such material may not be copied, reproduced, republished, modified, uploaded, posted, transmitted, or distributed in any way, including by e-mail or other electronic means, without the express prior written consent of The Hamper Emporium. Use of the materials on any other Web site or networked computer environment, or use of the materials for any purpose other than personal, non-commercial use is a violation of The Hamper Emporium copyrights, trademarks and other proprietary rights, and is prohibited.

The use of this website and these conditions shall be governed by and construed in accordance with the laws of Australia. By using this site, you agree to submit to the jurisdiction of the courts of Australia and any legal action pursued by you shall be within the exclusive jurisdiction of the courts of Australia.

Refunds

We ask that you please call our Customer Service Department on 1300 459 452 to discuss any queries or concerns you may have in relation to the Hamper/s you have sent or received.

Should you need to cancel your order, money will be refunded, ONLY IF notice is received by The Hamper Emporium 24 hours prior to the scheduled delivery date. Cancellations received with less than 24 hours notice will be charged at 50% of the total order value. We are unable to cancel orders that are already prepared and are with our couriers for delivery.

Note: All refunds for orders placed online or over the telephone are credited back the original credit card on which the order was purchased.

Product Substitutions

Because The Hamper Emporium use unique and great products if at any point we run out of a particular item we cannot duck down to Coles and Woollies to replace it, so we have to reserve the right to substitute products that may be unavailable, but we guarantee that the replacement item will be to equal or greater value than the original item. This may especially be applicable in late xmas for our Christmas Hampers.

Alcohol

All alcoholic products offered for sale by The Hamper Emporium are NOT available to persons under the age of 18 years. Under NSW Legislation hampers containing alcohol can only be purchased by someone other than the ultimate receiver and both the purchaser and the ultimate receiver need to be over 18 years of age.
